You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Certain features of the Platform — including saving listings, setting up search alerts, building collections, and accessing personalized recommendations — require you to create an account. When you register, you agree to provide accurate, current, and complete information and to update it as necessary.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or have been inactive for an extended period.

You agree not to:

Use the Platform for any unlawful purpose or in violation of any applicable local, state, national, or international law. Scrape, crawl, or use automated means to access or collect data from the Platform without our express written consent. Attempt to interfere with, compromise, or disrupt the Platform or its underlying infrastructure. Impersonate any person or entity, or misrepresent your affiliation with any person or entity. Use listing data obtained through the Platform for purposes other than personal, non-commercial real estate research. Reproduce, redistribute, or commercially exploit any content from the Platform without authorization. Upload or transmit viruses, malware, or any code of a destructive nature. Harass, abuse, or harm another person through the Platform.

The Platform displays property listings sourced from Multiple Listing Service (MLS) databases and other real estate data providers. This listing data is provided for your personal, non-commercial use only. You may not copy, redistribute, retransmit, or commercially exploit MLS data obtained through the Platform.

While we strive to keep listing information accurate and up to date, we do not guarantee the accuracy, completeness, or timeliness of any listing data. Listings may contain errors, may have been sold or leased, or may no longer be available. You should independently verify all property information before making any real estate decisions.

Market statistics, trend data, median prices, and other aggregated metrics displayed on the Platform are estimates based on available data and should not be relied upon as the sole basis for financial or real estate decisions.

Portions of the Platform use artificial intelligence to generate or enhance content, including but not limited to: neighborhood descriptions, property insights and analysis, search functionality, and market commentary. While we review AI-generated content for accuracy and compliance, such content is provided for informational purposes only.

AI-generated content does not constitute professional real estate advice, an appraisal, or a substitute for independent research and professional consultation. We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose.

All content on the Platform — including text, graphics, logos, images, data compilations, software, design, and layout — is the property of Abode Real Estate or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

The Abode name, logo, and all related marks are trademarks of Abode Real Estate. You may not use our trademarks without prior written consent. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms.

You may submit content through the Platform, including saved searches, property collections, notes, and other user-generated materials (“User Content”). You retain ownership of your User Content but grant Abode a non-exclusive, royalty-free, worldwide license to use, store, and process your User Content as necessary to provide and improve our services.

You represent that you have the right to submit any User Content and that it does not violate any third-party rights or applicable law. We may remove User Content that violates these Terms without notice.

The Platform integrates with and links to third-party services, including mapping providers, walk score calculators, and other real estate tools. These third-party services are governed by their own terms and privacy policies. We are not responsible for the content, accuracy, or practices of any third-party service.

Links to external websites are provided for convenience only and do not imply endorsement. We have no control over and accept no responsibility for the content of external sites.

If you opt in to receive SMS or text messages from Abode Real Estate, the following terms apply:

By providing your mobile number and confirming enrollment, you consent to receive recurring marketing and transactional text messages from Abode Real Estate. Message frequency varies. Consent to receive text messages is not a condition of any purchase or service.

You may opt out at any time by replying STOP to any message. Reply HELP for assistance. Message and data rates may apply. We are not responsible for delayed or undelivered messages due to carrier issues. Your mobile number and related data will be handled in accordance with our Privacy Policy.

Supported carriers include major U.S. carriers such as AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, and most regional carriers. Carrier participation may change without notice.

THE PLATFORM AND ALL CONTENT, MATERIALS, AND SERVICES PROVIDED THROUGH IT ARE OFFERED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, ABODE REAL ESTATE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components, or that any content is accurate, reliable, or complete. Property valuations, market statistics, and neighborhood information are estimates and should not be relied upon as appraisals or guarantees of value.

Abode Real Estate is a licensed real estate brokerage, not a financial advisor, appraiser, or legal counsel. Nothing on the Platform constitutes professional advice. You should consult qualified professionals before making real estate, financial, or legal decisions.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ABODE REAL ESTATE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID TO ABODE REAL ESTATE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

You agree to indemnify, defend, and hold harmless Abode Real Estate, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — shall survive.

You may terminate your account at any time by contacting us at [email protected]. Upon account deletion, we will remove your personal data in accordance with our Privacy Policy, subject to any legal retention requirements.

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois.

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute informally within thirty (30) days.

Abode Real Estate respects intellectual property rights. If you believe that content on the Platform infringes your copyright, please submit a DMCA notice to our designated copyright agent with the following information:

A description of the copyrighted work you claim has been infringed. The URL or location of the allegedly infringing material on the Platform. Your contact information (name, address, phone number, email). A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner. We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you via email or through the Platform. Your continued use of the Platform after any changes constitutes acceptance of the updated Terms.

We encourage you to review these Terms periodically. If you do not agree with any changes, you should discontinue use of the Platform.
